WEBSITE MEMBER NEWS POSTING GUIDELINES

Any and all postings to the Member News section of the NTEA’s website shall adhere to the following guidelines. The editorial staff of the NTEA is the sole authority for interpreting these guidelines and determining which member press releases will serve the membership and the industry. All submissions are subject to the Terms of Service Agreement (“TOS”), and to any editing, space limitations, deadlines and other requirements as may be established by the NTEA from time to time.

FORMAT

When submitting press releases for publication on NTEA.com, please restrict length to no more than 200 words. Longer releases may be declined by NTEA or edited for length . By using the Service (as defined in the TOS), including (without limitation) submitting Content for publication, you agree to comply with, and be bound by, all of the terms and conditions of the TOS and these guidelines.

CONDUCT

You understand that all information, data, text, software, music, sound, photographs, graphics, video, messages or other materials (“Content”), whether publicly posted or privately transmitted, is the sole responsibility of the person from which such Content originated. This means that you, and not the NTEA, are entirely responsible for all Content that you upload, post, email, transmit or otherwise make available via the Service. You understand that by using the Service, you may be exposed to Content that is offensive or objectionable. Under no circumstances will the NTEA be liable in any way for any Content, including, but not limited to, for any errors or omissions in any Content, or for any loss or damage of any kind incurred as a result of the use of any Content posted, emailed, transmitted or otherwise made available via the Service.

You agree to use the Service solely for the purpose of posting newsworthy information of general interest to the truck industry, such as (without limitation) product and similar announcements, the fact that your company has been awarded a contract or entered into a relationship with another company, personnel announcements, and legislative announcements that affect the industry. Opinion and editorial pieces are not considered newsworthy for these purposes and are not welcome.

In addition to the ban on op-ed pieces, Content is not welcome on the Service if it directly or indirectly (by links or references to other websites or otherwise):

(i) discusses prospective pricing or costs;

(ii) advocates, encourages or condones the boycott of any company or individual;

(iii) advocates, encourages or condones market allocation;

(iv) makes any personal attack on or against any person or company;

(v) is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another’s privacy, hateful, or racially, ethnically or otherwise objectionable;

(vi) advocates or discusses illegal activities with the intent of committing, or causing the commission of, such activities;

(vii) discusses religious or political viewpoints; or

(viii) advocates, encourages or condones any activity or action that the NTEA, in its sole discretion, finds hostile, unacceptable, offensive or inappropriate for the Service.

By using the Service, including (without limitation) submitting Content for publication, you agree not to use the Service to:

(i) impersonate any person or entity, including, but not limited to, an NTEA official, employee, agent, other NTEA representative, or member, or falsely state or otherwise misrepresent your affiliation with a person or entity;

(ii) forge headers or otherwise manipulate identifiers in order to disguise the origin of any Content transmitted through the Service;

(iiii) upload, post, email, transmit or otherwise make available any Content that you do not have a right to make available under any law or under contractual or fiduciary relationships (such as inside information, proprietary and confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements);

(iv) upload, post, email, transmit or otherwise make available any Content that infringes any patent, trademark, trade secret, copyright or other proprietary rights of any party;

(v) upload, post, email, transmit or otherwise make available any unsolicited or unauthorized advertising, promotional materials, “junk mail,” “spam,” “chain letters,” “pyramid schemes,” or any other form of solicitation, except in those areas (such as shopping rooms) that are designated for such purpose;

(vi) upload, post, email, transmit or otherwise make available any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment;

(vii) disrupt the normal flow of dialogue, or otherwise act in a manner that negatively affects other users’ ability to engage in exchanges;

(viii) interfere with or disrupt the Service or servers or networks connected to the Service, or disobey any requirements, procedures, policies or regulations of networks connected to the Service;

(ix) intentionally or unintentionally violate any applicable local, state, national or international law, including, but not limited to, regulations promulgated by the U.S. Securities and Exchange Commission, any rules of any national or other securities exchange, including, without limitation, the New York Stock Exchange, the American Stock Exchange or the NASDAQ, and any regulations having the force of law; or

(x) engage in any other activities deemed by the NTEA, in its sole discretion, to be offensive, harmful, inappropriate, disruptive or undesirable.

By using the Service, including (without limitation) submitting Content for publication, you acknowledge, consent and agree that the NTEA may or may not pre-screen Content, but that NTEA shall have the right (but not the obligation) in its sole discretion to pre-screen, refuse or move any Content that is available via the Service. The NTEA shall determine in its sole discretion how long to leave press releases in the Member News section (or other section) of the NTEA’s website, and whether to archive press releases. Without limiting the foregoing, the NTEA shall have the right to remove any Content that violates the TOS or is otherwise objectionable (as determined by the NTEA in its sole discretion). You agree that you must evaluate, and bear all risks associated with, the use of any Content (including without limitation press releases), including any reliance on the accuracy, completeness, or usefulness of such Content.

By using the Service, including (without limitation) submitting Content for publication, you acknowledge, consent and agree that the Service and software embodied within the Service may include security components that permit digital materials to be protected, and use of these materials is subject to usage rules set by NTEA and/or content providers who provide content to the Service. You will not attempt to override or circumvent any of the usage rules embedded into the Service. Any unauthorized reproduction, publication, further distribution or public exhibition of the materials provided on the Service, in whole or in part, is strictly prohibited.

COPYRIGHT

By your submission to NTEA you acknowledge and agree to publication of your press release in NTEA.com, NTEA News and any other NTEA publications and you grant the NTEA the licenses to use your press release, all in the manner indicated herein and in accordance with the terms and conditions in the TOS, and without royalty or other payment of any kind.
